Terms of Service

Agreement #

Sodium (the "service") is operated by Kay David Kalex ("we", "us", "our"), c/o Online-Impressum #4165, Europaring 90, 53757 St. Augustin, Germany. These Terms of Service (the "terms") form a binding agreement between you and us.

If you use Sodium on behalf of a Discord server or an organisation, you confirm you have the authority to accept these terms for it, and "you" means both you and that server or organisation. If you do not agree to these terms, do not use the service.

The service #

Sodium is an all-in-one bot for Discord that provides moderation, AI moderation, logging, tickets, a welcomer, a message builder and analytics, configured from the dashboard at sodi.dev. What each system does and stores is described in the documentation, which forms part of these terms.

We may add, change or remove features at any time. We aim to keep the documentation accurate, but the service is developed continuously and some behaviour may change before the docs catch up.

Eligibility #

You must be at least 13 years old to use Sodium, or older where your local law sets a higher minimum age for online services - for example 16 in parts of the European Economic Area. By using the service you confirm you meet this requirement and that you comply with the Discord Terms of Service and Community Guidelines.

Accounts & access #

The dashboard uses Discord to sign you in - we never see or store your Discord password. You are responsible for activity that happens through your Discord account and for keeping it secure. Access to a server's configuration is limited to members who hold Manage Server or Administrator on that server, the same gate Discord uses for adding bots.

Your responsibilities #

When you run Sodium on a server, you are the one deciding what it does there. You agree that:

• You will use Sodium only on servers you are authorised to administer.
• You are responsible for how you configure moderation, logging and every other system, and for the consequences of the actions Sodium takes on your behalf.
• You will tell the members of your server that Sodium is active and how it processes their data, as required by applicable privacy law. Our Privacy Policy is written to help you do this.
• You have a lawful basis to log, moderate and store the member data your configuration produces.

Acceptable use #

You must not use Sodium to break the law or to harm the service or other people. In particular, you agree not to:

• Abuse, overload, probe or attempt to disrupt the bot, the API or the dashboard, or circumvent rate limits, access controls or the invite-only gate.
• Reverse engineer, resell, rent or repackage the service except where that restriction is prohibited by law.
• Use the service to harass, surveil or target people unlawfully, or to process data you have no right to process.
• Use automated means to scrape or extract data from the dashboard beyond your own server's configuration.

We may suspend or remove Sodium from a server that violates these terms, that puts the service at risk, or that we are required to act on by Discord or by law.

Moderation & automation #

Sodium's moderation and AI moderation systems act automatically according to the rules and thresholds you set. AI scoring is probabilistic and will sometimes be wrong in both directions - flagging content that is fine, or missing content that is not.

Your data #

How we collect, use, store and delete data is set out in full in our Privacy Policy. In short: for the settings, cases, logs, transcripts and analytics tied to your server, you determine the purposes and Sodium acts as a processor on your behalf; for your dashboard account we act as the controller. Removing Sodium from a server deletes that server's settings, cases and logs automatically.

Subscriptions #

Adding Sodium and using its core systems is free. Paid subscriptions that unlock higher limits are not currently offered. If we introduce them, pricing, billing terms and the payment providers we use (which we expect to be Stripe and PayPal) will be presented to you before you are charged, and these terms will be updated accordingly. We do not collect or store card or bank details ourselves.

Availability #

We work to keep Sodium running, but we do not promise uninterrupted or error-free service. The service may be unavailable for maintenance, updates, outages, or reasons outside our control - including Discord downtime or API changes. We may modify, suspend or discontinue any part of the service at any time.

Intellectual property #

The Sodium name, logo, software, dashboard and site are owned by us and protected by intellectual property law. These terms grant you a limited, non-exclusive, non-transferable, revocable right to use the service as intended. Content you create with Sodium - message templates, configurations and the like - remains yours.

Termination #

You can stop using Sodium at any time by removing it from your servers and signing out of the dashboard. We may suspend or end your access if you breach these terms, if required by law, or if we discontinue the service. On removal, your server's data is deleted as described in the Privacy Policy. Sections that by their nature should survive termination - ownership, disclaimers, liability and governing law - continue to apply.

Disclaimers #

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy or non-infringement, to the fullest extent permitted by law. We do not warrant that the service will meet your requirements or that moderation results will be accurate. Nothing in these terms excludes rights that cannot be excluded under the law that applies to you, including mandatory consumer rights.

Limitation of liability #

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits, or goodwill arising from your use of - or inability to use - the service. As Sodium is provided free of charge, our total aggregate liability to you is limited to the greater of the amount you have paid us in the twelve months before the claim (currently zero) or EUR 100.

Nothing in this section limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be limited under German law or other mandatory law that applies to you.

Changes to these terms #

We may update these terms as the service evolves. When we make material changes we will update the date at the top of this page and, where appropriate, give notice through the dashboard or our community. Continuing to use Sodium after a change means you accept the updated terms.

Governing law #

These terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Where you use the service as a consumer, you keep the protection of the mandatory laws of your country of residence. Disputes fall under the jurisdiction of the competent courts in Germany, so far as the law permits.
